Terms of Service

Version 2.0 — Effective April 4, 2026

1. Acceptance of Terms

By accessing or using FairEnough (fairenough.life), you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. Description of Service

FairEnough is a web application that helps people negotiate changes in their interpersonal relationships — whether couples, roommates, friends, or colleagues — through a structured process of appreciation, listing, costing, revealing, negotiating, and tracking commitments. The service includes an AI-powered negotiation coach.

3. Account Registration

  • You must be at least 18 years old to create an account.
  • You must provide accurate, complete information during registration.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately if you suspect unauthorized access to your account.

4. Partnerships and Data Sharing

FairEnough connects you with a partner you invite. By creating a partnership, both parties consent to sharing the following data with each other, subject to the application's phase-gating rules:

  • Shared with your partner: Items listed, costs assigned, trade proposals, agreed commitments, check-in notes, adherence ratings, and appreciation messages (after mutual reveal).
  • Private to you: Your individual AI coaching conversations, items and costs before mutual reveal, and account settings.

Either partner may independently freeze or leave a partnership at any time. If you feel unsafe, you may delete your account or freeze the partnership without your partner's consent.

5. Acceptable Use

You agree not to:

  • Use the service to harass, threaten, or intimidate your partner or any other person
  • Submit content that is illegal, abusive, or violates another person's rights
  • Attempt to access another user's account or data without authorization
  • Use automated tools to scrape, crawl, or overload the service
  • Reverse-engineer, decompile, or disassemble any part of the application

6. AI Coach Disclaimer

The AI negotiation coach provides informational suggestions to help facilitate fair negotiations. It is not a substitute for professional counseling, therapy, mediation, or legal advice. AI suggestions are generated algorithmically and may not be appropriate for every situation. FairEnough is not liable for any decisions you make based on AI-generated content. If you need professional advice, consult a licensed therapist, mediator, or attorney.

7. Privacy

Your use of FairEnough is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

8. Intellectual Property

The FairEnough application, including its design, code, and content, is owned by Mid-Continental Dental Supply Company Ltd. and protected by intellectual property laws. FairEnough™ is a trademark of Mid-Continental Dental Supply Company Ltd. You retain ownership of the content you submit (items, notes, messages). By submitting content, you grant us a limited license to store and display it as necessary to provide the service.

9. Pricing and Fees

FairEnough is currently offered free of charge to early adopters. We reserve the right to introduce paid plans, modify pricing, or change which features are included in free and paid tiers at any time. If we introduce fees for features you currently use for free, we will provide at least 30 days' notice via email. Your continued use of the service after pricing changes take effect constitutes acceptance of the new terms. Existing data and history will remain accessible regardless of plan changes.

10. Indemnification

You agree to indemnify, defend, and hold harmless FairEnough, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any third party's rights.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will make reasonable efforts to notify users before any significant changes.

12. Account Termination

You may delete your account at any time from the Settings page. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

13. Limitation of Liability

FairEnough is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

14. Force Majeure

FairEnough shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, internet or infrastructure outages, acts of government, pandemics, or third-party service failures.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration in Winnipeg, Manitoba, Canada, except where prohibited by applicable law.

Consumer protection carve-outs: This arbitration clause does not apply where prohibited by law, including but not limited to the Province of Quebec (Consumer Protection Act, s. 11.1) and jurisdictions within the European Union. Nothing in this section limits your right to bring claims in small claims court or limits statutory consumer rights that cannot be waived under applicable law.

16. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 30 days before the changes take effect. Continued use of the service after changes constitutes acceptance of the updated Terms.
